Separate webshop terms: for online purchases via shop.ezelectronics.nl, the general terms and returns policy of that webshop apply. In the event of a conflict, the webshop terms take precedence for the online purchase.
1. Definitions
EZelectronics: EZdomain, trading under the trade name EZelectronics, including its employees and the auxiliary persons it engages.
Customer: any natural person or legal entity that enters into a contract with EZelectronics or offers a device.
Consumer: a natural person who is not acting in the exercise of a profession or business.
Business customer: a customer acting in the exercise of a profession or business or on behalf of an organisation.
Device: the electronic product offered for examination, repair, maintenance, data recovery or another service.
Service: any work offered by EZelectronics, including diagnosis, examination, repair, maintenance, cleaning, testing, installation, software recovery, microsoldering, motherboard repair and data recovery.
Repair: work aimed at remedying or reducing a defect or malfunction.
Diagnosis: examination of the nature and probable cause of a defect or complaint.
Part: any new, used, refurbished, original, compatible or aftermarket part used in a service.
Data: files, accounts, settings, software, licences and other digital information accessible on or through the device.
In writing: by letter, email, WhatsApp, customer portal or other durable electronic means.
2. Applicability
These terms apply to all offers, appointments, quotations and contracts for services of EZelectronics.
Separate webshop terms apply to online product sales via shop.ezelectronics.nl.
Deviations only apply if they have been agreed in writing.
If a provision proves to be invalid or voidable, the other provisions remain in force. The parties will replace the provision concerned with a valid provision that corresponds as closely as possible to the purpose and intent of the original arrangement.
Mandatory consumer rights always take precedence over a conflicting provision in these terms.
EZelectronics makes these terms available before or when the contract is concluded in a way that allows the customer to store them.
This website shows reviews from Google Maps. Use of Google Maps features and content is subject to the Google Maps End User Additional Terms of Service and the Google Privacy Policy.
3. Formation of the contract
A request for an appointment, information or price estimate is not yet a definitive repair assignment.
The contract is formed when the customer agrees to the agreed service, price or price calculation and EZelectronics accepts the assignment.
Agreement may be given in the shop, by email, WhatsApp, telephone, website, customer portal or in another unambiguous manner.
The intake, quotation, invoice, correspondence and any particulars stated therein form part of the contract.
EZelectronics may refuse an assignment if performance is unsafe, unlawful, technically irresponsible, not economically worthwhile or not reasonably feasible.
EZelectronics may ask for proof that the customer is the owner or lawful user of the device.
4. Prices, quotations and additional work
Prices for consumers include VAT, unless expressly and as permitted by law stated otherwise. For business customers, a price may be shown excluding VAT if this is clearly indicated.
A price estimate is based on the information available at that time and is not binding if examination reveals a different or additional defect.
A fixed price or accepted quotation is only increased with the customer’s consent, except where a small additional action is reasonably part of the agreed service and does not cause any meaningful extra costs.
If additional work is needed, the customer receives an additional price quotation or clear cost estimate before it is carried out.
Quotations are valid for 14 days, unless another period is stated.
EZelectronics may ask for a deposit for expensive, rare or model-specific parts and for extensive work.
Shipping, examination, call-out, storage or other additional costs are communicated as clearly as possible before the contract or before those costs arise.
5. Cooling-off period for services at a distance or off-premises
If a consumer concludes the contract entirely at a distance, for example via the website, email, WhatsApp or telephone, or off-premises, the consumer in principle has a cooling-off period of 14 days from the day on which the contract was concluded.
There is no statutory right of withdrawal for a contract concluded at the physical premises, unless EZelectronics expressly offers otherwise.
The consumer may withdraw within the cooling-off period by means of an unambiguous statement by email or using the model form in the annex.
If the consumer wants EZelectronics to start within the cooling-off period, the consumer must expressly request this in advance.
If the consumer withdraws after the service has started at the consumer’s express request, EZelectronics may charge a proportionate amount for the part performed up to the moment of withdrawal, provided the consumer was correctly informed of this in advance.
The right of withdrawal only lapses after the service has been fully performed, if performance began with the consumer’s prior express consent and the consumer stated in advance that the right of withdrawal lapses after full performance.
After a valid withdrawal, EZelectronics will refund amounts received no later than within 14 days, less any lawfully owed proportionate amount for work already performed.
If the consumer has not been correctly informed about the cooling-off period, the statutory consequences of this, including extension of the withdrawal period, may apply.
6. Cancellation and ordered parts
Outside any applicable statutory cooling-off period, the customer may cancel an assignment. EZelectronics may then charge the reasonably incurred and demonstrable costs, including labour already performed, examination and parts, to the extent this was agreed in advance or reasonably follows from the assignment.
The mere fact that a part has been specially ordered or is model-specific does not exclude a consumer’s statutory right of withdrawal.
If a consumer withdraws within the cooling-off period after the service has started at the consumer’s express request, article 5 applies and an amount is only charged to the extent permitted by law.
After the cooling-off period has ended, or for an assignment concluded in the shop, demonstrable costs of a part already ordered that cannot be returned free of charge may be passed on to the customer if the customer cancels the assignment.
EZelectronics limits cancellation costs to reasonable costs and takes account of savings and any possibilities of still using or returning the part.
7. Customer’s obligations
The customer provides correct and complete information about the complaint, previous repairs, drop, pressure, moisture, power or fire damage, software changes and other relevant circumstances.
The customer declares to be authorised to offer the device for repair and to give the necessary permissions.
The customer removes, where possible, SIM cards, separate memory cards, cases and accessories not needed for the repair.
The customer makes an up-to-date backup before the repair and takes appropriate measures to protect sensitive information.
Damage or delay arising directly from incorrect, incomplete or withheld information is not at the expense of EZelectronics, unless EZelectronics nevertheless failed to exercise the care that could reasonably be expected.
8. Performance and turnaround time
EZelectronics carries out work carefully, competently and in accordance with the arrangements made.
Where a specific repair result has been agreed, the performance must meet that arrangement. For diagnosis, data recovery, water damage, motherboard repair and other uncertain repair attempts, a best-efforts obligation applies, unless a result has been guaranteed in writing.
Stated repair and delivery times are indicative, unless a strict deadline has been agreed in writing.
EZelectronics informs the customer when a significant delay is expected.
EZelectronics may engage carefully selected third parties for specialist work. EZelectronics remains responsible towards the consumer for proper performance of the contract.
If hidden, previous or related damage becomes visible during disassembly, EZelectronics discusses the consequences and possible next steps with the customer before meaningful additional work is carried out.
9. Diagnosis and examination costs
For diagnosis, specialist examination, disassembly, water damage, data recovery and motherboard repair, examination or labour costs notified in advance may apply.
These costs may be due if repair proves impossible or the customer does not choose repair after diagnosis, provided the customer was informed of this in advance.
Examination costs are not charged if EZelectronics, as seller, is obliged to remedy a defect free of charge under the statutory warranty.
If examination costs are offset upon agreement to the repair, this is stated in advance.
10. Parts and quality
EZelectronics uses parts suitable for the agreed purpose and informs the customer where possible about relevant quality choices.
Depending on the chosen option, original new, original used, refurbished, compatible, aftermarket or own-brand parts may be used.
With compatible or aftermarket parts, differences may exist in, among other things, colour reproduction, brightness, finish, fit, touch sensitivity, battery status, software messages or functionality.
EZelectronics reports known material differences in advance when these are relevant to the customer’s choice.
Manufacturers may link functions to serial numbers, software, calibration or secured components. EZelectronics only guarantees preservation or restoration of such functions if this has been expressly agreed.
A software message about a replaced or unknown part does not in itself mean that the repair is defective, but the customer is informed of this when such a message is expected in advance.
11. Parts supplied by the customer
EZelectronics only fits a part supplied by the customer if this is considered technically and safely justifiable.
The customer bears the risk for the origin, quality, authenticity, compatibility and service life of the supplied part.
EZelectronics gives no commercial warranty on the supplied part. Warranty on the fitting only applies to the extent the fitting itself was carried out defectively.
Diagnosis, fitting and disassembly costs remain due if the supplied part proves defective, unsuitable or incompatible, provided these costs were known in advance.
EZelectronics is not liable for damage caused solely by a defective supplied part, unless EZelectronics knew or should reasonably have recognised the defect and did not warn the customer.
12. Access codes, accounts and privacy on devices
Access to certain functions may be necessary for diagnosis and the final check. The customer may unlock the device personally or voluntarily provide a temporary access code or test account.
Without access, EZelectronics may not be able to test all functions. Functions not tested are stated on the intake or invoice where possible.
An access code provided is only used for the agreed work and is not kept longer than necessary.
EZelectronics does not open personal files or accounts, except where this is reasonably necessary for diagnosis, repair or a data transfer requested by the customer.
EZelectronics does not cooperate in bypassing security when ownership or authority has not been made sufficiently plausible.
The processing of personal data is described further in the privacy statement.
13. Data, software and data recovery
The customer remains responsible for a recent and verifiable backup of data, unless making a backup has been expressly agreed as a service.
Repair, diagnosis, updates, reset, reinstallation, storage replacement and board-level work may cause data loss. EZelectronics warns in advance when a relevant risk is foreseeable.
Data recovery is a best-efforts obligation. Full, partial or lasting recovery cannot be guaranteed.
In data recovery, securing data comes first; the device need not be fully or permanently usable afterwards.
Temporary copies are kept securely and deleted after completion in accordance with the privacy statement, unless another retention period has been agreed or is legally required.
EZelectronics is not liable for data loss resulting from the original defect, normal risks discussed in advance or necessary repair actions, unless the loss results from an attributable failure by EZelectronics.
14. Water damage, moisture damage and corrosion
Examination and treatment of liquid, moisture and corrosion damage are uncertain repair attempts.
Corrosion and short-circuit damage may later spread or cause malfunctions again, even if the device works temporarily.
Cleaning is intended to limit damage and increase the chances of recovery and is no guarantee of full or lasting recovery.
Examination, cleaning and labour costs agreed in advance remain due if repair proves impossible.
EZelectronics remains responsible for careful performance, but not for defects arising from moisture, corrosion or short-circuit damage already present and not caused by careless conduct of EZelectronics.
15. Motherboard, soldering and complex repairs
Motherboard repairs, microsoldering, trace repair, chip work and connector repair are specialist work with increased technical uncertainty.
The outcome depends in part on hidden damage, previous repairs, corrosion, overheating, short circuits and availability of parts.
Unless a specific result has been guaranteed in writing, a best-efforts obligation applies to this work.
If new defects become visible, the customer receives an additional price quotation before meaningful additional work.
Diagnosis and labour costs agreed in advance may remain due if full repair is not possible.
16. Batteries, chargers and safety
Batteries are wear parts. Capacity and service life depend on, among other things, age, use, temperature, charging behaviour, software and quality.
Warranty on a replaced battery covers material and fitting faults and not normal capacity loss or damage from improper use, heat, moisture, drops or unsuitable charging equipment.
If a battery or device poses a safety risk due to swelling, leakage, heat, damage or short circuit, EZelectronics may stop using, charging or fitting it.
EZelectronics may take reasonable safety measures, including disconnecting power, storing safely and advising on replacement or responsible disposal.
A dangerous device is only shipped if this is justifiable under the applicable transport and safety rules.
17. Testing, water resistance and manufacturer’s warranty
After the repair, EZelectronics tests the functions reasonably related to the work carried out that can be checked without available access or additional means.
The customer checks the device on collection and reports visible deviations as soon as possible.
After opening or repair, original water or dust resistance cannot be guaranteed, even if seals are replaced.
EZelectronics therefore does not present a device as waterproof after repair, unless this has been expressly agreed in writing and suitably tested.
A repair by an independent repairer may affect a commercial manufacturer’s warranty or service programmes. The consumer’s statutory rights against the seller of the device remain unaffected.
18. Payment and right of retention
Payment takes place on collection, before return shipment or at the other agreed time.
Business customers can only pay on account after written permission. The payment term is then 14 days, unless otherwise agreed.
In the event of late payment, the statutory interest and, after a correct reminder, the legally permitted extrajudicial collection costs apply.
EZelectronics may retain the device until due amounts sufficiently related to the assignment have been paid, to the extent the statutory right of retention permits this.
Ownership of separate products and parts supplied by EZelectronics only transfers after full payment, to the extent this retention of title is legally possible.
19. Collection, storage and uncollected devices
The customer collects the device within 14 days of the first collection notice, unless otherwise agreed in writing.
If the device is not collected within this period, EZelectronics sends at least one reminder to the customer’s last known contact details.
After this reminder, EZelectronics may give the customer a final collection period of at least 14 days in writing. This final reminder clearly states from which date storage costs will be charged.
If the device has still not been collected after the final collection period has ended, EZelectronics is entitled to charge storage costs of € 5.00 including VAT per week or part thereof. The total storage costs amount to at most € 50.00 including VAT per device.
Storage costs only accrue as long as the device is kept by EZelectronics and stop on the date on which the device is collected by or on behalf of the customer or otherwise lawfully transferred.
The device remains the property of the customer. EZelectronics does not sell, destroy or recycle an uncollected device without the customer’s express consent or another valid legal basis.
In the case of prolonged non-collection, EZelectronics may take further reasonable and legally permitted steps to arrange payment, collection, storage or termination of the storage situation.
The customer is responsible for keeping contact details up to date. Messages are sent to the contact details last provided by the customer.
20. Warranty on repairs
EZelectronics gives a standard commercial warranty of 1 year on the part replaced by EZelectronics and the repair carried out, unless a different period is stated on the quotation, order confirmation or invoice.
The warranty covers the same defect in the replaced part or a demonstrable error in the work carried out.
The warranty does not limit a consumer’s statutory right to a service that conforms to the contract. If the work was not carried out as agreed and this is attributable to EZelectronics, EZelectronics will remedy this free of charge within a reasonable period.
The warranty does not apply to a new or unrelated defect, normal wear, accident, drop, impact, pressure, moisture, liquid, fire or user damage, unsuitable charging equipment, third-party software or interventions by the customer or another repairer.
Physical screen damage such as broken glass, LCD or OLED breakage, pressure marks, ink stains and lines caused by pressure or impact is not covered by the warranty on the previous screen repair.
No warranty on the final or lasting result is given for water damage treatment, data recovery and uncertain board-level repair attempts. An error in the performance itself does remain at the expense of EZelectronics.
The customer reports a warranty complaint as soon as possible and enables EZelectronics to examine the device and, if applicable, repair it free of charge itself.
If lifetime warranty is expressly stated on the invoice, it applies exclusively:
to the original customer and the same device;
to the specifically named part or the named repair;
to material or fitting faults and not to normal wear;
as long as the device has not been opened or altered by a third party;
as long as repair is technically safe and reasonably feasible.
In the event of a valid claim under the lifetime warranty, EZelectronics chooses free repair or an equivalent part. If this is not reasonably feasible due to permanent unavailability of parts or technical impossibility, EZelectronics may refund the amount originally paid for the repair concerned; that commercial warranty then ends.
Lifetime warranty is not transferable, unless otherwise stated in writing, and does not apply to batteries or other normal wear parts unless expressly stated on the invoice.
21. Sale of products outside the webshop
When a product is sold at the physical premises, the product description, condition, price and warranty information provided at the sale apply.
A consumer is entitled to a product that meets what could reasonably be expected on the basis of the contract, price, age, condition and statements.
A commercial warranty does not limit the consumer’s statutory rights.
Known defects and signs of use that were clearly reported before purchase and accepted by the customer do not count as unexpected defects.
Online purchases via shop.ezelectronics.nl are subject exclusively to the separate webshop terms and the returns policy published there.
22. Purchase of used devices
The selling customer declares to be the owner of the device and authorised to sell it.
The device must not be stolen, leased, blocked, financed, pledged or otherwise encumbered with third-party rights.
Accounts, Find My, iCloud, Google, Samsung, MDM, BIOS and other locks must be removed before definitive purchase, unless otherwise agreed in writing.
A provisional purchase price becomes definitive after checking the model, storage capacity, condition, operation, serial number, locks and origin.
In the event of a relevant deviation from the information provided, EZelectronics may make an adjusted proposal or decline the purchase.
EZelectronics may refuse a purchase or ask for additional identification if there is doubt about ownership, origin or authority.
The customer is responsible for deleting or securing personal data before transfer. EZelectronics may wipe and reconfigure the device after purchase.
23. Complaints and free repair
A complaint must be clearly reported as soon as possible after discovery. A consumer complaint reported within 2 months of discovery is in any event timely.
Complaints can be submitted via info@ezelectronics.nl or through the complaints procedure.
EZelectronics confirms receipt as soon as possible and aims to respond to the substance within 14 days. If more time is needed, the customer receives an indication of the further period.
The customer gives EZelectronics a reasonable opportunity to examine the device and to remedy an attributable error free of charge.
If the customer has work carried out by a third party without a reasonable opportunity for examination or repair, those costs are not automatically reimbursed by EZelectronics.
Submitting a complaint only suspends a payment obligation to the extent permitted by law or agreed in writing by the parties.
24. Liability
EZelectronics is liable for damage that is the direct result of an attributable failure on its part, to the extent determined by law and the circumstances of the case.
EZelectronics is not liable for pre-existing damage, hidden defects, normal wear, design faults, manufacturer faults or damage inherent in a repair risk clearly discussed in advance and accepted by the customer, unless EZelectronics acted with insufficient care.
The customer limits damage by providing relevant information, making a backup and following warnings or safety advice.
For consumers, liability and compensation are not limited further than permitted under mandatory law.
For business customers, liability for indirect damage, consequential damage, loss of turnover, loss of profit, business interruption and missed savings is excluded, except in the case of intent or conscious recklessness on the part of the management of EZelectronics.
Total liability towards a business customer is limited to the amount paid out by the liability insurance in the case concerned. If no payment is made, liability is limited to the invoice amount of the assignment concerned, up to a maximum of € 2,500, except where such a limitation is not permitted by law.
No provision excludes liability for damage caused by intent or conscious recklessness on the part of the management of EZelectronics, death or personal injury to the extent exclusion is not permitted by law, or other liability that may not be limited under mandatory law.
25. Force majeure
In the event of force majeure, EZelectronics may suspend performance for as long as the force majeure continues.
Force majeure includes circumstances beyond the reasonable control of EZelectronics, such as serious illness, fire, theft, power or internet failure, transport problems, import restrictions, government measures, shortages and failures at essential suppliers.
EZelectronics informs the customer as soon as possible of a significant delay.
If the force majeure lasts so long that continuation cannot reasonably be required of a party, the part of the contract not yet performed may be terminated. Work correctly performed and parts supplied remain payable.
Mandatory consumer rights continue to apply.
26. Personal data
EZelectronics processes personal data for purposes including intake, communication, performance, payment, administration, warranty, complaint handling and security.
Data on devices is only viewed to the extent necessary for the agreed service.
Further information about categories of data, legal bases, retention periods and privacy rights can be found in the privacy statement.
27. Changes and version management
EZelectronics may amend these terms for future contracts.
An ongoing assignment remains subject to the version that applied when the contract was concluded, unless the change is solely to the customer’s advantage or the customer agrees to the new version.
The current version is available on ezelectronics.nl and, on request, in a storable format.
28. Applicable law and disputes
Dutch law applies to the contract.
The parties first try to resolve a dispute through mutual consultation.
A dispute is submitted to the court that has jurisdiction under the law.
A consumer retains the protection of mandatory provisions of the law of the country where the consumer habitually resides, when that protection applies under applicable international consumer law.
